..Respondents Writ Petition filed under Article 226 of the Constitution of India seeking issuance of a Writ of Certiorarified Mandamus calling for the records in respect of the Notice dated 22.01.2026 issued by the fourth respondent under

Section 7 of the Tamil Nadu Land Encroachment Act, 1905, on the petitioner and his family and to quash the same and restrain the respondents in taking coercive methods to take possession of the property belonging to the petitioner and his family and to follow the procedure contemplated under law. ORDER

(Made by S.M.Subramaniam J.) This writ petition has been instituted challenging the show cause notice issued under Section 7 of the Tamil Nadu Land Encroachment Act, 1905.

2. A show cause notice will not provide cause for instituting writ proceedings. The petitioner is at liberty to file his explanation along with the documents, if any, before the competent authority to defend his case.

3. Learned counsel for the petitioner would submit that such a representation has already been submitted. Thus, the competent authority is bound to consider the same and thereafter, take a final decision for removal of encroachment, if any identified, by following all further procedures under the provisions of the Tamil Nadu Land Encroachment Act, 1905.
