The applicant states that the sale deed could not be produced at the time of filing the suit because the certified copy was with the Engineer at that point of time. The respondents have no objection to this application being allowed subject to their objections inter alia on grounds of relevance and proof.

2. The suit was filed in the year 2021 and is at the pre-trial stage. The applicant has also set out reasons for non filing of the documents along with the plaint. As such, reasonable cause is made out. The application is allowed subject to the objections of the respondents inter alia on the grounds of relevance and proof. The respondents are permitted to file the statement of admission / denial in respect of the additional documents filed by the counter party. The plaintiffs are directed to file a revised memo of admission / denial setting out reasons for denial of documents.
