Prayer : Writ Petition filed under Article 226 of the Constitution of India praying to issue appropriate writ orders or direction and in particular issue a Writ of Mandamus directing the respondents to pay the difference in Gratuity and leave salary with 10% interest as per 13th wage settlement dated 04.01.2018, last 10/11 days salary with 10% interest and 10% interest for belated payment of terminal benefits such as gratuity and leave salary to the petitioners.

ORDER

This Writ Petition has been filed in the nature of a Mandamus seeking a direction against the respondents to pay the difference amount of what was paid and what the petitioners claim should have been paid with respect to gratuity, leave salary and if the petitioner is entitled, to pay the same with interest. The petitioners also seek 10/11 days of salary which also to be paid to the petitioners. The petitioners further seek interest for the delayed payment of terminal benefits like gratuity and leave salary.

2. Heard the learned counsel for the respondents.

3. The respondents may examine the service records of the petitioners and examine the eligible amounts which are due and payable to the petitioners. If the petitioners are eligible for any payment,disburse the same within a period of three months from the date of receipt of a copy of this order with interest at the rate of 6% per annum from the date of retirement till the date of actual disbursement. 2/4

4. With the above directions, the Writ Petition stands disposed of. No costs.
