This Court already framed issues on 14.03.2022 and this application has been filed by the 1st defendant to frame additional issues.

2. Heard the learned counsel for the applicant and the learned counsel for the respondents.

3. On a perusal of the affidavit filed in support of this petition, it is seen that the points raised by the applicant are necessary for effective trial in the suit and further the learned counsel for the respondents have also no objection. Therefore, this application is allowed and the following additional issues are framed.

1. Whether the suit for bare injunction is maintainable without seeking any declaratory relief?

2. Whether the plaintiff being the mother of the first defendant can maintain the suit as framed with reference to residential house of the family?

4. The above said additional issues are framed. Registry is directed to refer the matter to the Master for recording evidence and list the matter before this Court after recording evidence.

5. The Master is directed to submit the report along with the depositions and documents marked, if any.

6. Since the suit is riped for trial, the order of interim injunction passed by this Court dated 31.03.2021 is made absolute. 08.04.2022 ksa-2 Page No.2/3
