O R D E R

The petitioner has come forward with this petition to direct the learned Principal District and Session Judge, Cuddalore to consider the bail application on the same day on surrender of petitioner in P.R.C. No.182 of 2010 on the file of the learned District Munsif-cum-Judicial Magistrate, Tittakudi, Cuddalore District.

2.Heard the learned counsel appearing for the petitioner and the learned Additional Public Prosecutor appearing for the respondent and perused the materials placed on record.

3. It is seen that earlier in Crl.O.P.No.20878 of 2011 an order had been passed by this Court on 08.09.2011 directing the petitioner to pay a sum of Rs.500/- (Rupees five hundred only) to the Chief Justice Relief Fund, High Court, Madras and on such payment, she was directed to surrender before the Trial Court. https://hcservices.ecourts.gov.in/hcservices/

4. The learned counsel for the petitioner submits that the petitioner had paid a sum of Rs.500/- (Rupees five hundred only) but did not surrender before the trial court for the last four years as she was hospitalised.

5. Under such circumstances, the petitioner is directed to pay a sum of Rs.1,000/- (Rupees one thousand only) to the District Legal Services Authority, Cuddalore within a period of one week from the date of receipt of copy of this order and surrender before the trial court and file an Application under Section 70(2) of Cr.P.C., The Trial Court is directed to liberally consider the same and pass appropriate orders on merits and in accordance with law on the same day.
