Respondent PRAYER: Petition under Section 11 of the Contempt of Courts Act to initiate contempt proceedings against the respondent for willful disobedience and not implementing in letter and spirit the directions issued in Contempt Petition No.1319 of 2015, dated 13.10.2015 in W.P.No.31402 of 2014, dated 1.12.2014.

ORDER

(Order of the Court was made by the Hon'ble Chief Justice) A simple direction made by the Court on 1.12.2014 for the representation of the petitioner to be disposed of within one month is being shunted from one department to the other. This is most unfortunate. We may note that when the contempt petition was filed by the petitioner https://hcservices.ecourts.gov.in/hcservices/

(2) earlier, on 13.10.2015, an undertaking was given to this Court that decision will be taken within a maximum period of one month from the petitioner furnishing the information and the departmental proceedings would be concluded within one month. Still there is no movement.

2. The learned counsel for the respondent states that necessary action will be taken within two weeks. We take the said stand on record and dispose of the petition.

3. List for compliance on 25.11.2016.

4. We make it clear that if the compliance does not take place within two weeks, the contemner will remain personally present in Court with records.
