PRAYER: Criminal Original Petition filed under Section 482 of Cr.P.C. praying for a direction, to direct the 1st & 2nd respondents herein not to harass the petitioner in the name of enquiry on the basis of any unfounded complaint of alleged practice of allopathic medicine, without following due process of law.

O R D E R

(The case has been heard through video conference) This petition has been filed seeking a direction, to direct the 1st & 2nd respondents herein not to harass the petitioner in the name of enquiry on the basis of any unfounded complaint of alleged practice of allopathic medicine, without following due process of law.

2. Heard Mr.R.Veeramani, learned counsel appearing for the petitioner and Mr.M.Mohamed Riyaz, learned Additional Public Prosecutor appearing for the respondents.

3.The learned Additional Public Prosecutor submitted that the petitioner is not a Doctor and that all the certificates produced by the petitioner do not belong to any degree or diploma to practice as a Medical Practitioner. He would further submit that the petitioner is simply mentioning his name as Dr.G.Koteeswaran, who is not entitled to practice under Allopathy or any other form of medicine.

4.On perusal of records, the petitioner has not proved that he is qualified as a doctor. Even then, his name is shown as Dr.G.Koteeswaran and therefore the petitioner is not at all entitled to practice as a doctor. Further, the petitioner is hereinafter restrained to mention his name as Dr.G.Koteeswaran, and if he uses his name as Dr.G.Koteeswaran, the second respondent is hereby directed to take appropriate action as against the petitioner.

5.Registry is directed to print the name of the petitioner without mentioning the designation doctor in the order copy. 6.With the above direction, this Criminal Original Petition is dismissed.
