PRAYER: Petition filed under Section 397 and 401 of Criminal Procedure Code prays that the judgment in C.C.No.379 of 2009 dated 02.12.2010 on the file of the Principle Assistant Sessions Judge, Villupuram in acquitting the respondents 2 to 11 may be revised and set aside and convict the respondents 2 to 11 for the offences under section 147, 436 of I.P.C. Against respondents 2 and 4 under Section 352 and 436 read with 149 against respondents 5 and 6, against respondent 8 under section 147, 352, 506 (2) and 436 read with 149 and against the respondents 7, 9 and 11 under Section 147, 506 (2) and 436 read with 149.

ORDER

The learned counsel for the revision petitioner fairly states that the revision is not maintainable, as against the order of acquittal passed by the Sessions Court. Accordingly, the learned counsel seeks permission of this Court to withdraw https://hcservices.ecourts.gov.in/hcservices/

the revision petition with liberty may be given to him to file an appeal. He has also made an endorsement to that effect.

2. The said endorsement is recorded. The petitioner is permitted to withdraw the revision petition with liberty to file an Appeal before the Appellate Court along with necessary application, under Section 14 of Limitation Act. It is made clear that the period of pendency of this revision before this Court shall be taken into account by the Appellate Court. 3.With the above observation, this petition stands dismissed as withdrawn.
