ORDER : The Court Made the following order :- The petitioners, who apprehend arrest at the hands of the respondent police for the alleged offences punishable under Sections 302 of IPC and Section 174 of Cr.P.C., in Crime No.87 of 2022, on the file of the respondent police, seek anticipatory bail.
2. The petitioners herein are the father-in-law, motherin-law and husband of the deceased Kurinchi Tamil, who not only committed suicide, but also before committing suicide, she killed her two minor children by strangulation. A complaint has been given by the mother of the deceased alleged that her daughter has taken this extreme steps due to ill treatment she met at the hands of the petitioners. These petitioners apprehending arrest by the respondent police are before this Court seeking anticipatory bail. https://hcservices.ecourts.gov.in/hcservices/
3. The police are unable to find out the immediate cause for forcing the deceased Kurinchi Tamil, who killed her children and committing suicide. The occurrence has taken place in the house where she and the petitioners herein were residing together the cause for her death is within the exclusive knowledge of these petitioners who are now absconding and not available for investigation.
4. The learned Government Advocate (crl.side) states that these petitioners except once had not cooperated with the investigation.
5. In the said circumstances, this Court is of the view that unless these petitioners are secured, taken into custody and interrogated, the immediate cause for the death cannot be ascertained. Therefore, this court is not inclined to grant anticipatory bail in this case in view of non cooperation of these petitioners.
