DATED: 03.06.2025

CORAM

THE HONOURABLE MR JUSTICE P.B. BALAJI Tr.C.M.P.No.299 of 2024 & CMP.No.6039 of 2024 Bhuvaneshwari ... Petitioner vs.

Manivasagan ... Respondent PRAYER: Transfer Civil Miscellaneous Petition filed under Section 24 of Code of Civil Procedure to withdraw FCOP.No.21 of 2024 on the file of the Family Court, Ariyalur and transfer the same along with M.C.No.1 of 2023 on the file of the Family Court, Namakkal.

For Petitioner : Mr.J.Jayan

ORDER

The petitioner seeks transfer of FCOP.No.21 of 2024 pending on the file of the Family Court, Ariyalur to the file of the Family Court, Namakkal, to be tried along with M.C.No.1 of 2023, which has been filed by the petitioner pending on the file of the Family Court, Namakkal. 1/3

2.Heard the learned counsel for the petitioner. Despite service of notice on the respondent, the respondent has not chosen to enter appearance either in person or through counsel. The name of the respondent is also printed in today's cause list. The respondent is called and set ex-parte. 3.It is seen from the affidavit filed in support of the petition that the petitioner/mother has a mentally disabled son, having serious health issues and it would be very inconvenient for the petitioner to travel all the way from Namakkal to Ariyalur to attend the proceedings in FCOP.No.21 of 2024. I find a good case made out for the transfer petition being allowed as prayed for. Accordingly, this Tr.CMP.No.299 of 2024 is allowed. The case in FCOP.No.21 of 2024 is hereby withdrawn from the file of the Family Court, Ariyalur and transferred to the file of the Family Court, Namakkal to be tried along with M.C.No.1 of 2023. There shall be no order as to costs. Connected Civil Miscellaneous Petition is closed. 03.06.2025 ata 2/3
