This Civil Miscellaneous Petition is filed seeking to condone the delay of 503 days in filing the above Appeal.

2. Though the learned counsel appearing for the Respondent/ESI Corporation expressed objection to the condonation of delay, he submitted that, if the Court is inclined to condone the delay, the same may be ordered, subject to payment of costs.

3. In view of the above and on being satisfied with the reasons stated in the Affidavit accompanying this Petition, this Miscellaneous Petition seeking to condone the delay of 503 days in filing the above Appeal is ordered, as prayed for, subject to payment of costs of a sum of Rs.1,000/- (Rupees One Thousand only) by the Petitioner to the Respondent/ESI Corporation, on or before 07.02.2020.

4. If costs are paid and proof of the same is filed into the Registry, the Civil Miscellaneous Appeal shall be numbered, provided it is otherwise in order and the matter shall be listed 'for admission'. If costs are not paid within the time stipulated, the Civil Miscellaneous Petition shall stand automatically dismissed without reference to this Court.
