This petition is filed by the petitioner to modify the condition imposed upon him to execute a bond for a sum of Rs.75,000/- before the Principal Special Court under EC and NDPS Act, Chennai in Crl.R.C.No.61 of 2023 vide order dated 22.02.2023 in Crime No.577 of 2022.

The learned counsel for the petitioner submitted that on 22.02.2023 this Court allowed the Crl.R.C.No.61 of 2023 by setting aside the impugned order passed by the court below and directed the respondent Police to return the vehicle to the petitioner on condition that the petitioner shall execute a bond for a sum of Rs.75,000/- before the Principal Special Court under EC and NDPS Act, Chennai. He further submitted that the petitioner is not having sufficient means of finance to execute the bond for a sum of Rs.75,000/-, therefore he could not mobilise the funds to comply with the above said condition. Thus, he prayed for modification of the above said condition.

3.The learned Government Advocate(Crl.Side) appearing for the respondent submitted that the worth of the vehicle in question is more than Rs.1,00,000/-. Therefore, he prayed for dismissal of this petition. 4.Heard the learned counsel for the petitioner and learned Govt. Advocate (crl.side) and perused the accompanying affidavit filed in support of the petition.

5.Considering the submissions of the learned Government Advocate (Crl.Side) appearing for the respondent that the value of the vehicle is more than Rs.1,00,000/- and also the order of this Court directing the petitioner to execute the bond for a sum of Rs.75,000/- is not onerous one, this Court is not inclined to modify the condition imposed on the petitioner in paragraph No.9 (iii) of the order passed in Crl.R.C.No.61 of 2023, dated 22.02.202 and accordingly, this petition stands dismissed.
