ORDER
The writ petition has been filed to issue a mandamus to the respondents to pay the petitioner, interest at the rate of 12% per annum on the belated payment of terminal benefits, viz., Provident Fund, Gratuity and Surrender Leave Salary amounting to Rs.17,80,297/- for the period from 30.06.2022 to 23.05.2023 and further direct the respondents to pay the difference of Gratuity and the difference of Leave Salary arising out of the settlement dated 30.09.2019 together with interest thereon from the date on which the said amounts became due till the date of actual payment within a time frame. The case of the petitioner is that he was appointed as a Conductor in the Transport Corporation on 21.02.1999 and had retired from service as Special Grade Conductor, through Voluntary Retirement Scheme on 31.06.2022.
However, the terminal benefits have been settled to the petitioner belatedly only on 23.05.2023, and no interest has been paid for the delayed period. Therefore, the petitioner had submitted a representation to the respondents dated 18.12.2025, to pay the interest for the delayed period. Since the same was not considered, the present writ petition has been filed.
3. The petitioner also pleads in the affidavit that he is entitled for the difference in gratuity amount and difference in leave salary amount along with interest , pursuant to the Settlement entered on 30.09.2019. 3.
The learned Standing Counsel for the respondents would fairly submit that they are willing to pay the interest at the rate of 6% per annum for the belated payment of the eligible and admissible amount. 4.
Heard the learned counsel for both sides and perused the materials available on record.
5.1 In view of the above submission of the learned Standing Counsel, this Court deems it appropriate to direct the respondents to pay interest at the rate of 6% per annum for the belated payment of admissible terminal benefits from the date of retirement till the date of actual disbursal of the terminal benefits of the petitioner, within a period of six weeks from the date of receipt of a copy of this order.
5.2 With regard to the consequential relief seeking payment of difference of Gratuity and the difference of Leave Salary arising out of the 3/5
settlement dated 30.09.2019 together with interest thereon, the respondent shall consider the representation and pass orders if the petitioner is eligible for the same. The representation of the petitioner shall be considered within a period of six weeks from the date of receipt of a copy of this order.
6. With the above directions and observations, the writ petition is disposed of. No costs.
