PRAYER: To direct the 1st respondent to dispose the Statuary Appeal filed by the petitioner on 14.10.2024 by taking note of order passed by the 2nd respondent in his proceedings No. DC4/ 4400/ 2013 (Board Secretariat) dated 23.02.2024 within a stipulated time.

ORDER
This writ petition has been filed seeking a direction to the 1st respondent to dispose the Statuary Appeal filed by the petitioner on 14.10.2024 by taking note of order passed by the 2nd respondent in his proceedings No. DC4/ 4400/ 2013 (Board Secretariat) dated 23.02.2024 within a stipulated time. 2.The case of the petitioner is that the petitioner is working as Junior Assistant in the Tamil Nadu Housing Board and due to the alleged misconduct of the petitioner, the petitioner was awarded with the punishment of one increment cut without cumulative effect for six months in discharge of charges framed against him by Proceedings No.DC4/4400/2013 dated 04.09.2024. Aggrieved by the said order, the petitioner has preferred an appeal on 14.10.2024 before the first respondent and has sent a representation to the first respondent to consider his appeal and reinstate him to service. However, since no action has been taken, the petitioner has come to this court by way of this petition. 2/5
3.The learned counsel for the petitioner submits that the charges were framed on the petitioner for the misconduct committed by him in collusion with one N.Parimala, who was working as Junior Assistant and it is submitted that subsequently, by Proceedings No.DC4/4400/2013 dated 23.02.2024, the charges framed against the said Parimala was dropped and the individual is deemed to have been reinstated into service and deemed to have been allowed to retire and the period of suspension is treated as duty in discharge of charges framed against her. Hence, the learned counsel for the petitioner submits that the appeal of the petitioner may also be directed to be considered and pass appropriate orders. 4.Heard the learned counsel for the petitioner and the learned standing counsel appearing for the respondents.
5.In view of the facts and circumstances of the case, particularly the fact that the action against the co-delinquent Parimala had been dropped, the first respondent is directed to dispose of the statutory appeal filed by the petitioner on 14.10.2024 by taking note of the order passed by Proceedings No.DC4/4400/2013 dated 23.02.2024 within a period of one month from the date of receipt of a copy of this order.
