ORDER
This Civil Miscellaneous Petition has been filed seeking to condone the delay of 1887 days in representing the revision petition.
2. Mr.P.Valliyappan, learned Senior Counsel appearing for the petitioner submitted that though the rental arrears as on date works out to a sum of Rs.1,90,080/-, the petitioners have already deposited a sum of Rs.84,480/- before the trial Court and they have no objection in the respondent withdrawing the same.
3. He further submitted that pursuant to the order passed by this Court on 06.03.2025, today, the petitioners have handed over the Demand Draft for the balance rental arrears (Rs.1,05,600/-) vide Demand Draft No.245221 dated 10.03.2025 drawn in favour of the respondent. He further submitted that the delay in representing the petition is on account of the time taken to implead the legal heirs of the deceased petitioners. Therefore, the delay is neither willful nor wanton and he would seek to condone the delay in representation.
4. Mr.K.Karthikeyan, learned Government Advocate (HR & CE) appearing for the first respondent received the Demand Draft dated 10.03.2025 drawn for a sum of Rs.1,05,600/-, furnished by the petitioners. Further, he expressed that he has no objection for this petition being allowed.
5. Heard both sides and perused the materials available on record.
6. Taking into consideration the submissions made by the learned Senior Counsel appearing for the petitioner and the reasons adduced in the affidavit filed in support of this petition, this Civil Miscellaneous petition stands ordered. Thereby, the delay of 1887 days in representing the Civil Revision Petition is condoned.
7. Registry is directed to number the main revision petition, if it is, otherwise, in order and list the main revision petition on 18.03.2025. The Registry shall also print the name of Mr.K.Karthikeyan, learned Government Advocate (HR & CE) for the first respondent in the cause list at the time of admission of main revision petition.
