ORDER

The petitioner, who was arrested and remanded to judicial custody on 22.01.2026 for the alleged offences under Sections 296(b), 115(2), 125, 324(2), 309(4), 311 and 351(3) of BNS in Crime No.24 of 2026 on the file of the respondent police, seeks bail.

2. The case of the prosecution is that the petitioner waylaid the de facto complainant, demanded money and robbed Rs.650/- and also threatened him with dire consequences. Hence the case.

3. The learned counsel appearing for the petitioner submitted that the petitioner has been falsely implicated in the present case and that he has not committed any offence as alleged by the prosecution. He would further submit that the petitioner is ready to abide by any stringent conditions that may be imposed by this Court. Hence, he prays for grant of bail to the Petitioner.

4. Per contra, the learned Government Advocate (Criminal Side) appearing for the Respondent Police reiterated the prosecution case and submitted that totally there were 2 Accused. A1 has already been detained as Gunda and this petitioner/A2 has two previous cases pending against him. Hence, he strongly opposed for grant of bail to the petitioner.

5. I have given my anxious consideration to either side submissions and perused the materials available on record.

6. From the submissions made by the learned counsel for petitioner, it is seen that the petitioner is behind the bar since 22.01.2026 and the so called

offence of robbery was a put up case. However, this contention was totally objected by the learned Government Advocate (Crl.Side) and would contend that already two previous cases are pending against the petitioner in Ambattur Police Station and that the other accused who is A1 has already been detained as 'Goondas'. In such view of the position, if the petitioner is enlarged on bail at this stage, there is every possibility of tampering the witnesses. Thus, this Court is not inclined to enlarge the petitioner on bail at this stage. Hence, this Criminal Original Petition is dismissed.
