ORDER

This Writ Petition has been filed seeking issuance of a direction to the respondents to restore and continue the armed police protection to the petitioner by considering the petitioner's representation dated 13.12.2025 within a time frame to be fixed by this Court.

The petitioner has submitted a representation dated 13.12.2025 seeking restoration of Personal Security Officer (PSO) protection, which had been withdrawn on the same date. It is the contention of the petitioner that for the past 23 years, he has been associated with Hindu Parishad and has also joined the BJP political party wherein he is serving as the vice president of Krishnagiri West and he is an active political functionary. It is further stated that due to his political activities, he has developed enmity with hurling of a petrol bomb at his residence had occurred in this regard, a case in Crime No.1203 of 2020 dated 20.09.2020 and another case in Crime No.1312 of 2020, dated 18.12.2020 have been registered. It is submitted that from the year 2021, armed police protection was provided to the petitioner, which has now been withdrawn abruptly. According to the petitioner, the threat to his life still persists. Hence, he seeks consideration of his representation and restoration of armed police protection.

The learned Additional Public Prosecutor appearing for the respondents has filed a status report on behalf of the second respondent. 4.

From the report, it is seen that on 20.09.2020, a case in Crime No.1203 of 2020 was registered for the offences punishable under Sections 427, 324, 506(ii) IPC and the said case was subsequently closed on 20.04.2023.

Further, on 18.12.2020, seven polythene covers containing inflammable materials such as diesel/kerosene were found and a case in Crime No.1312 of 2020 was registered for the offence under Section 285 of IPC. Thereafter, the petitioner sought police protection from the District collector and the Superintendent of Police, pursuant to which, an armed police constable was deputed as a security guard. It is further stated that the petitioner is engaged in real estate and building contract works and the presence of an armed police personnel accompanying him has created an impression that police support is being extended for his business activities. The report further indicates that for the past four years, there has been no subsisting threat to the petitioner's life and upon such assessment, the armed police protection was withdrawn. 5.

A report has been submitted to the Superintendent of Police for consideration of the petitioner's representation along with the report of the second respondent. The Superintendent of Police is directed to consider the petitioner's representation dated 13.12.2025, in the light of the report submitted by the second respondent and take an appropriate decision regarding restoration of armed police protection, if the circumstances so warrant. Such decision shall be taken within a period of one month from 23.04.2026.

With the above directions, this Writ Petition stands disposed of. No costs.
