Respondents PRAYER: This Writ petition came to be numbered under Article 226 of the Constitution of India by way of transfer of O.A.No.4934 of 2002 from the file of the Tamil Nadu Administrative Tribunal praying for Mandamus, to direct the respondents to pay all the annual increments in the revised scale of pay for the post of Health Officer with effect from 6.4.90 with arrears of pay and all consequential service benefits and to direct the respondents to promote the applicant to the post of Deputy Director of Health Services retrospectively with effect from the date on which his immediate junior was promoted with monetary and attendant benefits.

O R D E R

The petitioner filed O.A. No. 4934 of 2002 before learned Tamilnadu Administrative Tribunal, which came on transfer to this Court as Writ Petition No. 7046/2007, seeking for a direction to the respondents to pay all the annual increments in the revised scale of pay for the post of Health Officer with effect from 6.4.90 with https://hcservices.ecourts.gov.in/hcservices/

arrears of pay and all consequential service benefits, with a consequential prayer to direct the respondents to promote the applicant to the post of Deputy Director of Health Services retrospectively with effect from the date on which his immediate junior was promoted with monetary and attendant benefits.

2. Mr. S.M. Subramaniam, learned counsel appearing for the petitioner submitted that the petitioner is no more and hence prayed this Court to close the writ petition.

3. Mr. N. Srinivasan, learned Additional Government Pleader appearing for the respondents also submitted that all the benefits have already been given to the wife of the deceased petitioner and hence the matter may be closed.
