Respondents Prayer: This Writ Petition is filed under Article 226 of the Constitution of India, seeking for a writ of mandamus, directing the 2nd respondent to issue patta on sub dividing the property measuring an extent of 5 cents out of 42 cents as per schedule in S. No.30/5E in Kadali Village Gingee Taluk to the petitioner Trust within jurisdiction of Vallathi Sub Registry on 8.12.2006 as per the schedule in the registered sale deed D. No.1164/2006 in favour of the petitioner on disposing the representation dated 4.5.2007 and 1.12.2014 sent by the petitioner on merits and to pay compensation of Rs.10 00 000/- along with heavy cost to be imposed with the time to be fixed by this Honourable Court. By consent, the writ petition is taken up for final disposal.
2. The petitioner claims that he is the Manager and Correspondent of St.Anne's R.C. Middle School and St. Anne's R.C. High School in Kadali Village, Gingee Taluk, Villupuram District and he is running the said schools for the past 48 years. The petitioner claims to have purchased a land comprised in S.No.30/6 measuring to an extent of 5 cents out of 42 cents in Kadali Village Gingee Taluk, within the jurisdiction of Vallathi SubRegistry on 08.12.2006 by registered sale deed D.No.1164/2006. The petitioner after purchase, submitted an application to the 2nd respondent for issuance of patta and to carry out necessary changes in the revenue records. In this regard, he has also submitted representations dated 04.05.2007 & 01.12.2014 to the District Collector, Villupuram and though, both the representations have been taken on file, the petitioner has not been favoured with any response and hence, he came forward to file this writ petition.
3. Heard the submissions of Mr.V.Subbarayan, learned counsel appearing for the petitioner and Mr.R.Vijayakumar, learned Additional Government Pleader, who accepts notice for the respondents.
4. Though, the petitioner prays for a larger relief, this Court, without going into the merits of the representations submitted by the petitioner, directs the first respondent to consider and dispose of the petitioner's representation dated 01.12.2014 on merits and in accordance with law, after putting on notice the persons concerned and pass orders within a period of twelve weeks from the date of receipt of a copy of this order and inform the decision taken, to the petitioner as well as to the persons concerned.
