Petition filed under Article 226 of the Constitution of India, praying for issuance of a Writ of Mandamus, to call for the records made in No.Estt/C1.10/2017 dated 13.09.2017 on the file of respondent herein and quash the same as illegal and direct the respondent to re-instate the petitioner into service with back wages and attendant benefits.

This is a case of prolonged suspension. This writ petition has been filed to set aside the order of the respondent in No.Estt/C1.10/ 2017 dated 13.09.2017 and to direct the respondent to reinstate the petitioner into service with back wages and attendant benefits.

2.When this writ petition was taken up, the learned counsel for the respondent University has fairly submitted that the petitioner was kept under suspension right from September 2017 onwards and in view of the same, the case of the petitioner would be considered as per the decision of the Hon'ble Supreme Court in Ajay Kumar Choudhary v. Union of India, reported in (2015) 7 SCC 291.

3.Recording the above submission made by the learned counsel for the respondent University, the writ petition is disposed of directing the respondent to consider the case of the petitioner in the light of the decision of the Hon'ble Supreme Court in Ajay Kumar Choudhary v. Union of India (supra) and pass https://hcservices.ecourts.gov.in/hcservices/

appropriate orders in accordance with law, within a period of two weeks from the date of receipt of a copy of this order. No costs. Consequently, the connected miscellaneous petition is closed.
