ORDER

The petitioner, as defacto complainant, filed a complaint which was registered in Crime No.4 of 2026 for offences under Section 296(b), 351(2) of

the Bharatiya Nyaya Sanhita read with Sections 3(1)(r) and 3(1)(s) of the SC & ST (Prevention of Atrocities) Rules, 1995.

2. The grievance of the petitioner is that, despite lodging the complaint, except for registration of the FIR, no investigation was conducted. Hence, on 08.01.2026, the petitioner sent a representation to the Inspector General, North Zone, Superintendent of Police, Cuddalore, and Deputy Superintendent of Police, Cuddalore. Despite the same, no action was taken, leading to the filing of this petition.

3. The learned Additional Public Prosecutor submitted that, on the basis of the petitioner's complaint, FIR was registered. On conclusion of investigation, the case has been closed as "mistake of fact" in R.C.S. No.2 of 2026. A copy of the RCS has been served on the petitioner's son and filed before the Sessions Court. Today, a copy has also been served on the counsel for the petitioner.

4. In view of the above, the learned counsel for the petitioner/complainant is at liberty to file a protest petition before the concerned court, if so aggrieved, within three weeks from the date of receipt of a copy of this order. The same shall be considered on merits.
