ORDER
This Criminal Original Petition has been filed by the petitioner under Section 482 Cr.P.C., to issue a direction to the 1st and 2nd respondents to provide police protection to the petitioners from the illegal activities of the 3rd and 4th respondents by considering the petitioners' representation dated 14.02.2019 and 18.02.2019.
2.The learned counsel for the petitioner would submit that the 3rd respondent is the 1st wife of the 2nd petitioner. Due to
some untold issues, their marriage got dissolved by the order passed by the learned Subordinate Judge-III, Madurai dated 06.08.2018 in H.M.O.P.No.52 of 2018. Subsequent to their divorce, the 2nd petitioner got married with the 1st petitioner on 05.10.2018. The said marriage is an inter-caste marriage. After which, the 1st petitioner was attacked by the 3rd respondent in front of the Government Hospital, Tiruppur. The 3rd respondent has been lodging complaint after complaint before the different forums and continuously using various methods and harassing the petitioners by using whatsapp, newspapers and you tube channel etc. The learned counsel would further submit that the 4th respondent is the Secretary of SC/ST association.
In view of the petitioners' inter-caste marriage, he conspired with the 3rd respondent and threatening the petitioners. There is a serious life threat to the petitioners and their family. The 2nd respondent police is acting in favour of the 3rd and refusing to take action against the 3rd respondent for the above said attack. Hence, the petitioners seek police protection from the hands of the 3rd & 4th respondents.
3.Heard the learned counsel for the petitioners and the learned Government Advocate (Criminal Side).
4.Considering the above submissions made by the learned counsel for the petitioner, the 2nd respondent is hereby directed to conduct enquiry on the representation dated 14.02.2019 and 18.02.2019 along with counterparts and pass orders on merits and in accordance with law within a period of two weeks from the date of receipt of a copy of this order.
4.Accordingly, this Criminal Original Petition stands disposed of.
