ORDER

The petitioner who was arrested and remanded to judicial custody on 09.12.2025 for the offence u/s 103(1) of BNS and it was altered u/s 103(1), 309(4),311, 238 of BNS in Crime No.516 of 2025 registered on the file of respondent police seeks bail.

2. The case of the prosecution is that the petitioner is having illicit relationship with the deceased. It is stated that that the petitioner is a police man and he promised the deceased that he will secure Government job and collected money from her. Thereafter, neither secured the job nor returned the money. On the date of occurrence the petitioner abducted her, after consuming liquor, thereafter murdered her by strangulation and thrown the body in the nearby dam. It is further alleged that the petitioner has also stolen the gold jewels of the deceased. Hence, the case.

3. The learned counsel for the petitioner submitted that the petitioner is arrested only based on the suspicion and he has not committed any offence as alleged by the prosecution. He further submitted that the petitioner is in Judicial custody from 09.12.2025 and he is ready to co-operate with the investigation and abide by any stringent conditions that may be imposed by this Court. Hence, he prays to grant bail to the petitioner.

4. The learned Government Advocate reiterated the prosecution case and submitted that the petitioner has been arrested and the gold jewels stolen by the petitioner has not yet been recovered and investigation in this case is pending. Hence, he opposed to grant bail to the petitioner. 2/4

5. Considering the submission made by the learned Government Advocate and the fact that the petitioner has committed murder for his personal gain and also screened the offence by throwing the body in the dam. Hence this Court is not inclined to grant bail to the petitioner.
