These petitions are filed seeking to condone the delay of 391 days in setting aside the abatement, to set aside the abatement caused due to the death of 2nd respondent, and to bring on record the proposed respondents 11 to 13 herein as legal representatives of deceased 2nd respondent.

2. Mr. J.Ramakrishnan, learned counsel for petitioners/appellants submitted that pending appeal, 2nd respondent died on 16.09.2017. Hence, he has filed the above petitions.

3. Mr.M.Balasubramanian, learned counsel appearing for the respondents 11 to 13 appeared and raised his objections.

4. Considering the facts and circumstances, and being satisfied with the reasons assigned in the affidavit, all the petitions are allowed on payment of cost of Rs.2000/- payable to the contesting respondents 11 to 13 on or before 11.07.2022. The proposed legal representatives of the 2nd respondent are impleaded as respondents 11 to 13 in the above Second Appeal. The learned counsel for petitioners/appellants are also directed to serve typed set of papers to the contesting respondents 11 to 13. 27.06.2022 rpp Note : The Registry is directed to carry out the necessary amendment in the cause title and list the matter on 11.07.2022. https://www.mhc.tn.gov.in/judis
