This petition has been filed to restore the Civil Miscellaneous Appeal No.369 of 2006 which was dismissed for default on 13.07.2010.

2. The learned counsel for the respondent would state that the appeal has been dismissed in the year 2010 and the restoration petition has been filed only in the year 2021.

3. The learned counsel for the petitioner submitted they are ready to forgo the interest for the default period.

4. Considering the reasons stated in the accompanying affidavit and recording the submissions of the learned counsel for the petitioner, this petition is allowed and the Civil Miscellaneous Appeal is restored.

4. Considering the reasons stated in the accompanying affidavit and recording the submissions of the learned counsel for the petitioner, this petition is allowed on payment of cost of Rs.2000/- [Rs.two thousand only] to the legal Services Authority within a period of two weeks.
