ORDER

The petitioner, who apprehends arrest at the hands of the respondent police for the offences punishable under Section 309(4) of the BNS in Crime No. 52 of 2025, on the file of the respondent police, seeks 1/4

anticipatory bail.

The case of the prosecution is that the petitioner along with the other accused had attacked the de facto complainant and robbed 1 1⁄2 sovereigns and two mobile phones.

The learned counsel appearing for the petitioner submitted that the stolen articles were recovered from the first accused and in any case custodial interrogation of the petitioner is not required and sought for anticipatory bail.

The learned Government Advocate (Crl. Side) appearing for the respondent police, while opposing the grant of anticipatory bail to the petitioner, reiterated the prosecution case and on instructions submitted the petitioner has 8 previous cases of which one is registered under Section 376 of IPC and others are registered under 379, 397 and 427 of IPC and that he is a habitual offender.

Heard the learned counsel for the petitioner and the learned Government Advocate (Crl.side) for the respondent and also perused the 2/4

materials available on record.

Considering the nature of the allegations, the fact that the petitioner has bad antecedents and that he is a history sheeter, this Court is not inclined to grant anticipatory bail to the petitioner. 7.
