Respondents Criminal Original Petition is filed under Section 528 of B.N.N.S., 2023, to call for records from the first respondent Police in Crime No.112 of 2010 and to quash the same insofar as the petitioner is concerned. O R D E R
This petition has been filed to quash the First Information Report in Crime No.112 of 2010 on the file of the first respondent Police.
2. Heard the learned counsel for the petitioner and the learned Government Advocate (Crl.Side) appearing for the first respondent and perused the materials available on record.
3. The case of the prosecution is that on 11.04.2010, at about 11:30 p.m., when the Sub-Inspector of Police was in the station, the de-facto complainant, viz., Mangai, lodged a complaint, stating that on 02.04.2010, the petitioner and his relatives issued a life threat to the de-facto complainant's brother while he was proceeding to the agricultural land. Thereafter, on 04.04.2010, at about 12:00 p.m., the petitioner and his relatives came to the de-facto complainant's house with an iron rod and attacked the de-facto complainant and her family members with a wooden log, abused her with filthy language and issued a life threat. Hence, the complaint.

4. Admittedly, the entire allegations are trivial in nature. Though it was alleged that the de-facto complainant was attacked with a wooden log, there is no injury. That apart, the First Information Report is pending from the year 2010 without any progress, and even then, there is no progress in the First Information Report. Therefore, there is no need to order notice to the second respondent, since it is already barred by limitation also.
5. In view of the above, this Court is inclined to quash the First Information Report. Accordingly, the First Information Report in Crime No.112 of 2010 is hereby quashed. Consequently, the connected Miscellaneous Petition is closed.
