The Criminal Original Petition has been filed seeking to direct the Fast Track Metropolitan Magistrate No.II, Egmore Court at Allikulam, Chennai to expedite the proceedings in C.C.No.9442 of 2018 now pending on his file.
2. Learned counsel appearing for the petitioner would submit that the petitioner is the complainant in C.C.No.9442 of 2018 pending on the file of the Fast Track Metropolitan Magistrate No.II, Egmore at Allikulam, Chennai for the offences punishable under Section 138 of the NI Act. After of the appearance of the accused, the proof affidavit of the petitioner was filed as early as on 14.10.2019 and the complainant side evidence was closed finally on 28.12.2021 and the matter was posted for hearing on 12.01.2022 for questioning the accused under Section 313 of Cr.P.C. From 12.01.2022, the case had been repeatedly https://hcservices.ecourts.gov.in/hcservices/
adjourned for several hearings, without questioning. The respondent/accused has been dragging on the proceedings. Thereby, the present petition has been filed to complete the proceedings as expeditiously as possible.
3. Heard the learned counsel and perused the materials available on record.
4. Taking into consideration the facts and submissions made by the counsel, a direction is issued to the trial Court to complete the trial as expeditiously as possible preferably within a period of four months from the next date of hearing i.e., 07.04.2022.
5. Accordingly, this Criminal Original Petition stands disposed of with the above direction.
