Today when the matter came up for hearing, the learned counsel for the respondent/complainant alone is present.

It is seen that there is no settlement between the parties and the petitioner is not surrendering before the Trial Court.

Therefore, the criminal miscellaneous petition is dismissed.

2.It will be open for the respondent/complainant to approach the Trial Court to issue/execute warrant and commit the petitioner to prison to serve the sentence.
