Prayer : Writ Petition filed under Article 226 of the Constitution of India for issuance of a Writ of Mandamus, directing the 3rd Respondent to cancel the Patta No.1 granted in favour of the Arulmigu Manmatheeswarar Thirukoil, Kuttalam for the land measuring the extent of 1.13 ares comprised in old survey no.119C/15 and new survey No.686/2 and Consequently direct the 4th respondents to issue patta for the petitioner for the land measuring the extent of 1.13 ares comprised in Old Survey No.119C/ 15 and new Survey No 686/2.

This writ petition has been filed for issue of writ of mandamus directing the 3rd respondent to deal with the representation made by the petitioner on 10.12.2022, wherein, the petitioner is seeking for the cancellation of the patta that stands in the name of the 5th respondent.

2.Heard Mr.U.Kathiravan, learned counsel appearing on behalf of the petitioner and Mr.P.Sathish, learned Additional Government Pleader appearing on behalf of the respondents.

3.Taking into consideration the facts and circumstances of the case and the materials placed before this Court, there shall be a direction to the 3rd respondent to deal with the representation made by the petitioner dated 10.12.2022, on its own merits and in accordance with law after affording an opportunity to the 5th respondent and final orders shall be passed, within a period of eight weeks from the date of receipt of copy of this order.
