This Writ Petition has been filed to issue a Writ of Mandamus, to direct the third respondent to grant patta to the petitioners who are residing at Banakkahalli Harijan Colony Sathamangalam Taluk, Erode District in respect of the lands measuring an extent of 1.57.0 hectares in S.F.No.121/6A of Banakkahalli Village in Sathyamanagalam by considering their representation dated 08.01.2024 .
2. Heard the learned counsel appearing for the petitioners and the learned Additional Government Pleader appearing for the official respondents and perused the materials available on record.
3. Having regard to the submissions made by the learned counsel on either side and taking into consideration the limited prayer sought for by the petitioners, without expressing any opinion with regard to the merits of the case, this Court directs the respondents to consider the petitioners' representation dated 08.01.2024, and issue notice to the petitioners, rival claimants/interested parties/aggrieved parties/objectors as the case may be and after giving notice to all the parties conduct enquiry in the manner known to law and pass orders on merits and in accordance with law. After conducting enquiry, if the respondents find that the petitioners are otherwise eligible/entitled to get patta, the respondents shall issue patta to the petitioners.
4. With the abovesaid direction, the Writ Petition is disposed of. There shall be no order as to costs.
