J U D G M E N T
[Judgment of the Court was made by S. M. SUBRAMANIAM, J.,] The present intra-Court appeal under Clause 15 of Letters Patent has been instituted challenging the day order passed by the writ Court on 03.02.2026 in W.M.P.No.4308 of 2026 in W.P.No.3894 of 2026.
2. The learned single Judge recorded the arguments placed before the Court and adjourned the matter to 10.02.2026. The learned counsel for the second respondent would submit that again the matter was adjourned for hearing on 20.02.2026 and it was further adjourned at the request of learned counsel for the appellant /writ petitioner. Again, the matter is posted for hearing during the first week of March 2026 and it is yet to be listed.
3. The learned counsel for the appellant would submit that the rights of differently abled persons, as protected under the Statute, are to be Page Nos.2/5
provided and that a long delay in disposal of the case would cause prejudice to the interests of these differently abled persons in securing public employment. The learned counsel would further submit that the legal issues have been framed by the writ Court and during the pendency of the writ petition, the selection process is to be concluded and selected persons are appointed. That being the case, the writ is to be heard urgently in order to consider the right of the petitioner for selection to the post of Sports Coach.

The learned Special Government Pleader for the first respondent would submit that the writ petition itself has been instituted seeking a direction to the respondents to pass orders on the petitioner's application and issue a hall ticket for the computer based examination scheduled on 04.02.2026 and permit the petitioner to participate in the computer based examination in accordance with law and recruitment notification issued. The said permission was already granted and the appellant has appeared in the computer based examination and therefore, the issue raised does not exist as of today.
5. Be that as it may, the present appeal has been filed against recording of the Court proceedings by the writ Court on 03.02.2026 and the matter was subsequently, adjourned for further hearing. That being Page Nos.3/5
the case, the present writ petition is unnecessary and parties are at liberty to adjudicate the issues on merits before the writ Court and the writ Court is requested to hear the matter as expeditiously as possible.
6. With the above observation the Writ Appeal stands dismissed. Consequently, connected miscellaneous petition is closed. There shall be no order as to costs.
