This Second Appeal has been filed to set aside the judgment and decree made in A.S.No.74 of 2012 on the file of the I Additional SubOrdinate Judge at Erode dated 05.04.2013, confirming the judgment and decree made in O.S.No.226 of 2007 on the file of the II Additional District Munsif Court at Erode dated 20.01.2012.

2. Heard Mr.P.K.Harinathbabu, learned counsel for the appellants and Mr.N.Manokaran, learned counsel for the first respondent.

3. The learned counsel for the appellants submitted that the matter has been settled out of Court and he made an endorsement to that effect.

4. In view of the above submission and endorsement, this Second Appeal is dismissed as not pressed. No costs. Consequently, connected miscellaneous petition is closed.
