This petition has been filed seeking to condone the delay of 8 days in filing the above Revision against the fair and decreetal order dated 19.07.2022 made in I.A.No.1 of 2022 in O.S.No.23 of 2013 on the file of learned Addl. District Court, Namakkal.

2. Mr.S.Dinu Prashanth, learned counsel for petitioner submitted that the copy application was filed on 26.07.2022 and it was made ready on 08.08.2022 and delivery taken on 12.08.2022. Subsequently, the petitioner was aged about 80 years, he was fell ill, and hence, he could not contact his counsel immediately and on his recovery, he contacted his counsel. However, there is a delay of 8 days arose in filing the above C.R.P. and the said delay caused is neither willful nor wanton, but for the above said reasons. Accordingly, he has filed the above petition.

3. Considering the fact that the 1st petitioner is aged about 80 years and the 2nd petitioner is aged about 70 years as well as on considering the reasons stated by the petitioner in the affidavit seems to be justifiable one, this court is inclined to allow this petition and Registry is directed to number the Civil Revision Petition if it is otherwise found to be in order. 24.03.2023 rpp https://www.mhc.tn.gov.in/judis
