M/S.Sree Gokulam Chit And Finance Co (P) Ltd, v. A.Liakathali Khan

Crl.O.P.No.8153 of 2024 in Crl.A.No.SR.1469 of 2023 M.DHANDAPANI.J., This Miscellaneous Petition has been filed seeking to grant special leave to prefer an appeal from the order of acquittal passed by the learned Judicial Magistrate-V, Salem in STC.No.40 of 2016 dated 13.03.2019.

2. The petitioner herein is the petitioner/complainant in STC.No.40 of 2016 and he has filed a private complaint against the respondent. The learned Judicial Magistrate-V, Salem dismissed the petition after hearing both sides. As against the order of the learned Judicial Magistrate, the petitioner has filed the Criminal Original Petition before this Court, seeking leave to file an appeal.

3. Heard the learned counsel for the petitioner and on being satisfied with the grounds made by the learned counsel for the petitioner and this Court is inclined to grant leave.

4. Special Leave is granted.
