Writ Petition filed under Article 226 of the Constitution of India praying for the issuance of a Writ of Mandamus, directing the respondents 1 & 2 to consider the Petitioner's representation dated 05.03.2015, wherein the petitioner made his objection to the present panel and include the petitioner in the tentative list of Assistant Divisional Engineer fit for promotion to the post of Divisional Engineer in Tamil Nadu Highways Engineering Services, made in G.O.Ms.No.12, Highways and Minor Ports (HK) Department dated 04.02.2015, by placing the petitioner at Sl.No.9, within a reasonable time to be fixed by this Court.

ORDER

Learned counsel appearing for the petitioner seeks permission of this Court to withdraw this writ petition and he has also made an endorsement to the effect that "As the petitioner's request has been rejected by an order in Memo No.1440/Confidential 1/2014, dated 12.03.2015 by the second respondent in writ petition, the petitioner may be granted liberty to challenge the same".

2. In view of the endorsement made by the learned counsel appearing for the petitioner, this Writ Petition is dismissed as withdrawn with liberty to challenge the order as per the said endorsement. No costs.
