The revision challenges the examination of P.W.1 and marking of two documents in the absence of the petitioner. 2.

Admittedly, the petitioner was absent and his counsel was also absent at the time of recording of evidence. Since the witness was produced before the Court on the said date, it cannot be said that the learned Chief Judicial Magistrate had violated any procedure in examining the witness. 3.

It is needless to say that the petitioner is always entitled to recall the witness and cross-examine him.
