ORDER

(Order of the Court was made by R. SURESH KUMAR, J.) The main contempt petition was closed vide the order dated 11.10.2023 by recording the submissions made by the respondent therein that partial encroachment has been removed and the remaining encroachments would be removed by following due process of law.

2. In the original order passed in W.P.No.27394 of 2022 dated 13.10.2022, it was a direction given by the Division Bench that after completing the survey, if any encroachment is found, the same shall be removed and the said exercise was directed to be complied with within a period of eight weeks.

3. Therefore, the entire encroachment, if it is found after survey, since has to be removed as per the order passed by this Court and it has been recorded by the Court that only partial encroachment has been removed and the remaining encroachments would be removed by following the due process of law and based on the said undertaking given by the respondent, though the contempt petition was closed by the order dated 11.10.2023, now, it is the grievance of the petitioner, who filed the present application, that the remaining encroachments found till date have not been removed.

4. In that view of the matter, we are inclined to accept this application by reviving the said contempt petition in Cont.P.No.653 of 2023.
