Respondents PRAYER: Writ Petition filed under Article 226 of the Constitution of India praying for the issuance of Writ of Mandamus, to direct the 1st respondent to give protection for petitioner to take the list of articles which are mentioned in the schedule, which are kept in Door No. 336, Thiruvalluvar Nagar, Athanur Village, Kuntrathur Taluk, Kanchipuram District.

ORDER

This Writ Petition has been filed seeking a direction to the first respondent to provide adequate police protection to enable the petitioner to take possession of certain articles, which are stated to be kept at Door No.336, Thiruvalluvar Nagar, Athanur Village, Kuntrathur Taluk, Kanchipuram District.

2. Heard the learned counsel appearing on either side and perused the materials available on record.

3. The petitioner has claimed to be the wife of the deceased Vanathaiyan, who was her third husband. Subsequently, the said Vanathaiyan died. The petitioner now wants to take her belongings from the house of the second respondent.

4. The learned counsel appearing for the second respondent submitted that the petitioner has already filed a partition suit in

O.S.No.418 of 2024, which is pending on the file of the Additional District Court, Kancheepuram.

5. It is seen that the petitioner claims to be the wife of the second respondent's father. However, the second respondent has denied the same and contended that the petitioner is not entitled to any relief. Consequently, a civil dispute is pending between the petitioner and the second respondent. That apart, the request to take the articles from the house of the second respondent cannot be granted. It is well settled that police protection cannot be granted in the matter relating to private civil disputes between the parties.

6. In view of the above, this writ petition lacks merit and is liable to be dismissed. Accordingly, this Writ Petition stands dismissed. No costs.
