ORDER

The petitioner who was arrested and remanded to judicial custody on 02.12.2025 for the offence u/s 331(4) and 305(1) of the BNSS, 2023 in Crime No.87 of 2025 registered on the file of respondent police seeks bail.

2. The case of the prosecution is that the petitioner trespassed in the house of the defacto complainant and stole 3 soverigns of gold and cash Rs.50,000/- . Hence, the case.

3. The learned counsel for the petitioner submitted that the petitioner is in judicial custody for more than 85 days and so far final report is not filed. He further submitted that the petitioner is ready to co-operate with the investigation and abide by any stringent conditions that may be imposed by this Court. Hence, he prays to grant bail to the petitioner.

4. The learned Government Advocate reiterated the prosecution case and submitted that there are 27 previous cases pending against the petitioner 2/4

and investigation is not yet completed and only part of the stolen property is recovered. Hence, he opposed to grant bail to the petitioner.

5. Considering the submission made by the learned Government Advocate' nature of offence; bad antecedents of the petitioner and the stolen property is not yet recovered, this Court is not inclined to grant bail to the petitioner.
