This Writ Petition has been filed challenging the impugned order dated 10.10.2012 in I.D.No.30 of 2010 passed by the first respondent, thereby ordered to reinstate the respondents 2 and 3 herein with continuity of service, full back wages and other attendant benefits.
2. The petitioner and the respondents 2 & 3 are present before this Court and they also represented that they have settled the issue amicably by way of Joint Memo of Compromise dated 19.07.2023.
3. It is seen that pending Writ Petition, the parties have settled the issue amicably and to that extent they executed a Joint Memo of Compromise dated 19.07.2023 and the same is extracted hereunder :
1. We the petitioner the 2nd respondent and 3rd respondent herein hereto have sorted out our dispute and differences between ourselves out of our own consent and willingness and thereby have entered into a joint compromise memo.
2. The 2nd respondent and 3rd respondent submit 2/5
that we hereby in pursuance of the compromise do hereby withdraw the allegation made against the petitioner in I.D.No.30 of 2010 before the Labour Court, Puducherry.
3. We the petitioner, 2nd respondent and 3rd respondent jointly submit that we are withdrawing our respective allegation made against each other's in the above proceedings in view of this compromise being entered between us.
4. The petitioner submits that the respondents 2 & 3 were receiving 17-B wages from the year 2013 and now to resolve the dispute once for all had enter into present joint compromise.
5. The petitioner agrees to settle the respondents 2 and 3 to a tune on one lakhs each and the same is also accepted by the respondents 2 & 3 and the petitioner pay Rs.1,00,000/- (One Lakhs only) to both the respondent by way of Cheque No.291033, Indian Bank, Ariyankuppam Branch, Puducherry to 2nd respondent Rajendiran and Cheque No.291034, Indian Bank, Ariyankuppam Branch, Puducherry to 3rd respondent Ravi @ Ramasamy. Therefore, in pursuant to this joint compromise entered between the parties all disputes are hereby resolved amicably.
3. The Joint Memo of Compromise dated 19.07.2023 shall 3/5
form part and parcel of this order. As per the said Joint Memo of Compromise, this Writ Petition is disposed of. Consequently, connected miscellaneous petition is closed.
