Criminal Appeal filed under Section 378(4) of Criminal Procedure Code, to set aside the acquittal of the respondent/accused of the offences under Sections 409 and 420 of I.P.C., passed by the learned II Metropolitan Magistrates' Court, Egmore, Chennai by order dated 10.02.2010 in C.C.No.9621 of 2007 and punish the respondent/accused with the maximum punishment permissible.

ORDER

This is an appeal against acquittal filed against the judgement dated 10.02.2010 made in C.C.No. 9621 of 2007 by the II Metropolitan Magistrates' Court, Egmore, Chennai - 600 008. By the said judgment, the respondent is acquitted of an offence under Section 409 and 420 of Indian Penal Code.

2. It can be seen that when the matter earlier came up for hearing from the year 2018, there has been no representation on behalf of the appellant. Today also (i.e. on 06.06.2025), there is no representation on behalf of the appellant.

3. In view thereof, this Criminal Appeal No.180 of 2010 is dismissed for non prosecution. No costs.
