Petition filed under Article 226 of the Constitution of India for the issuance of writ of Mandamus, directing the respondents to count the service rendered by the petitioner in the post of Panchayat Clerk/Panchayat Assistant from 05.01.1984 to 02.06.2005 along with the service rendered in the post of Junior Assistant and RWO-I from 03.06.2005 to 30.06.2014 and grant him pension and other retirement benefits.

O R D E R

The petitioner initially worked as Panchayat Clerk from 05.01.1984 to 02.06.2005. Thereafter, he was appointed as Junior Assistant by transfer on 03.06.2005. It is the grievance of the petitioner that his earlier service was not taken into account for the purpose of counting total service. The petitioner submitted a representation on 19.12.2014, requesting the first respondent to count his earlier service. However, there was no follow up action taken by the first respondent, resulting in filing this writ petition.

2. The first respondent is directed to consider and dispose of the representation submitted by the petitioner dated 19.12.2014 in the light of the order dated 02.04.2009 in W.P.No.5017 of 2008 and the related judgment of the Division Bench dated 23.01.2013 in W.A.No.186 of 2013, Such exercise shall be completed within a period of three months from the date of receipt of a copy of this order.

3. The writ petition is disposed of with the above direction. No costs.
