ORDER

This Writ Petition has been filed to call for the records relating to the notice dated 06.02.2026 issued by the 2nd respondent in Letter No.BR//2526/81, consequently direct the respondent bank to continue to pay rents to the rented premises viz.,U78, Nagapillayar Kovil Street, Kovaipudur, Coimbatore 641042 belonging to the petitioner, with 15 percentage increase on the prevailing rent for every three years during the lease period up to 31.01.2028.

The brief facts leading to the filing of the Writ Petition are as follows:- The petitioner is the owner of the premises, wherein the 2nd respondent -bank approached the petitioner for establishment of the said Bank in the year 2013 and the lease agreement for a period of 15 years from 22.02.2013 to 31.03.2028 was executed at the rate of Rs.15/- per sq.ft., having an area of 2280.3 sq.ft., and the rent will be enhanced at 15% for every three years. The said agreement was registered. The 2nd respondent by a communication dated 23.09.2025 issued a letter intimating that for operational convenience and business requirements they intend to vacate the rented premises stating

that it is a preliminary intimation. Though the petitioner submitted a detailed letter dated 02.10.2025 intimating that they are ready to construct car parking and other facilities as per the requirements of the respondents' bank, the respondents-bank by way of a letter dated 06.02.2026 issued a communication stating that they would vacate the rented premises within three months from 06.02.2026. Challenging the same, the present writ petition has been filed.

3. Heard the learned counsel appearing for the petitioner and perused the documents placed on record. Since no adverse orders have been passed as against the respondents, notice to the respondents is dispensed with.

4. Considering the facts and circumstances of the case and without expressing any opinion on the merits of the case, this Writ Petition is disposed of by directing the respondents to consider the representation of the petitioner dated 02.10.2025 on merits and pass appropriate orders after providing opportunity to the petitioner within a period of six weeks from the date of receipt of copy of this order. Consequently, connected miscellaneous petition is closed. No costs.
