PRAYER: This criminal Original petition has been filed under Section 439(1)(b) of BNSS Act, to modify the condition that the petitioner / accused is directed to deposit a sum of Rs.1,00,000/- (Rupees One Lakh only) into the concerned Judicial Magistrate, Additional Mahila Court, Dharmapuri in Crime No.26 of 2025 of Thoppur Police Station, in Crl.M.P.No.182/2025 in Crime No.26/2025 dated 18.02.2025 order passed by the learned Hon'ble Principal District Judge, Dharmapuri.

ORDER

The petitioners/A1 and A2, who were granted anticipatory bail by the learned Principal District Judge, Dharmapuri, in Crl.M.P.No.182 of 2025, seeks modification of the condition 9(b), to deposit Rs.1,00,000/- (Rupees One Lakh only) to the credit of Crime No. 26 of 2025.

2. The learned counsel for the petitioners/A1 and A2, would submit that the allegations are false; and that there is a counter case and the condition directing them to deposit Rs.1,00,000/- (Rupees One Lakh only) is onerous and sought for setting aside the said condition.

3. The learned Government Advocate (Crl.Side) for the respondent, on instructions, submitted that the total value of the damage caused to the property of the de-facto complainant is Rs.18,450/-.

4. Considering the aforesaid submissions, this Court is of the view Page No.2 of 4

that the condition directing the petitioners to deposit Rs.1,00,000/- (Rupees One Lakh only) can be modified directing the petitioners to deposit Rs.15,000/- (Rupees Fifteen Thousand only) to the Credit of Crime No. 26 of 2025, within a period of two weeks from the date of receipt of a copy of this order. The other conditions imposed in the order dated 18.02.2025 in Crl.M.P.NO.182 of 2025 shall remain unaltered.

5. Accordingly, the Criminal Original Petition is ordered and the condition is modified.
