JUDGMENT

On an earlier occasion, it was recorded by this Court vide order dated 07.03.2025 that the sole respondent is no more and the learned counsel for the appellant has also made an endorsement to that effect in the case bundle.

2. When the case came up for hearing today (i.e.04.02.2026), the learned counsel for the appellant as well as the respondent present in the Court and it is submitted as the sole respondent has passed away and that the learned counsel for the respondent also confirms that the sole respondent died on 28.12.2023 as per the postal endorsement received by him.

3. No steps has been taken to bring on record the legal heirs of the deceased respondent till date.

4. Hence, this second appeal stands abated.
