ORDER

This writ petition has been filed for issue of writ of mandamus directing the 1 st respondent to consider the representation made by the petitioner on 20.01.2025, wherein, the petitioner is seeking for the cancellation of a registered document registered as Document No.50/1978.

2.Heard Mr.A.Arasu Ganesan, learned counsel appearing on behalf of the petitioner and Mr.P.Harish, learned Government Advocate appearing on behalf of respondents 1 to 3.

3.In the considered view of this Court, the power to cancel a registered document which was available under Section 77A of the Registration Act has already been held to be unconstitutional by the Division Bench of this Court in M.Kathirvel vs. The Inspector General of Registration, Department of Registration and others reported in 2024 4 CTC 769. Therefore, there is no

3/5 scope for the registering authorities to cancel any registered document and if at all the petitioner has any grievance, she can only approach the competent Civil Court and workout her remedy. Except giving this clarity, no further orders can be passed in this writ petition.
