PRAYER : Criminal Original Petition filed under Section 482 of Criminal Procedure Code, to direct the respondent police to complete the investigation in respect of Crime No.259 of 2022 to file the charge sheet in accordance with law within the period that may be stipulated by the Court. ORDER
This criminal original petition has been filed to direct the respondent police to complete the investigation in respect of Crime No.259 of 2022 to file the charge sheet in accordance with law 1/4
2.The learned Additional Public Prosecutor on instructions submitted that the investigation was completed in Crime No.259 of 2022 and it has been closed as 'Mistake of Fact' and the closure report has also been filed before the concerned jurisdictional Court on 02.01.2023 . 3.In the light of the above submission, there shall be a direction to the respondent police to serve the RCS notice on the defacto complainant. If the defacto complainant is aggrieved by the closure report, it is left open to the defacto complainant to workout his remedy by filing a protest petition and proceed further in accordance with law.
4.Accordingly, this criminal original petition is disposed of in the above terms.
