Heard learned counsel for the applicant and learned counsel for the non-applicants.

Learned counsel for the non-applicants submits that the only ground mentioned for condonation of delay is that the appeal was filed by the respondent and the said matter is referred for mediation. The applicant was hopeful that the mediation proceedings would be decided and the litigation would end. He submits that the same cannot be a ground for condonation of delay, much less the same is a sufficient cause.

It appears that the applicant was not to gain by delay. The reasons are mentioned in the accompanying affidavit in the application. For the reasons mentioned in the application, the delay is condoned. The application is allowed and disposed of.
