Appeal as against the judgment and decree dated 20.04.2018 made in I.A.No.163 of 2017 in O.S.No.163 of 2014 on the file of the learned First Additional District and Sessions Court, Tiruppur.

J U D G M E N T
(Judgment of the Court was delivered by N. KIRUBAKARAN,J.) Both the appellant as well as the respondents are present before the Court along with their respective counsels. The parties mutually agreed that the appellant would take the red colored portion marked in the Ex.C.7/Sketch filed by the learned Advocate Commissioner and that the respondents would take the https://hcservices.ecourts.gov.in/hcservices/
blue and green colored portion marked in the said sketch. Since there is no bore well facility either in the blue colored portion or in the green colored portion, the appellant agreed to pay a sum of Rs.4,00,000/- [Rupees Four Lakhs Only] within a period of 90 days from today, so as to enable the respondents to dig a bore well, which facility is already available in the red colored portion. As far as the other conditions are concerned, they have been clearly specified in the memo of compromise dated 28.09.2018 signed by both the parties and counter-signed by the respective counsels. By virtue of this compromise memo, the parties are put in possession in their respective portion. 2.The Appeal Suit is disposed of in terms of the memo of compromise. No costs. Connected miscellaneous petition is closed. The memo of compromise dated 28.09.2018 shall form part of the decree.
